Bankruptcy Is Not an End But Instead a Beginning

A beginning for a new life, one free of sleepless nights and embarrassing phone calls. A beginning that allows for a hopeful future, free from the past. The fresh start you deserve.

Find out more information about the two main types of bankruptcy below. Then call Edwin Glover, Attorney at Law to discuss what type of bankruptcy attorney services may be right for you.

THE DIFFERENCES BETWEEN CHAPTER 7 & 13

Chapter 7:This is what is usually referred to as a "general discharge." There are two main benefits with Chapter 7, as you:

• Will totally eliminate most unsecured debts (such a credit card debt)
• May be allowed to keep your vehicles and house (provided the equity is within certain limits)

Certain debts are not dis-chargeable such as student loans, child support, alimony and many taxes. Chapter 7 bankruptcy is not available to everyone. It depends upon a "means test." If your income is high and your living expenses are low, you may not have Chapter 7 as an option. The rules determining which debts can be discharged fully and whether or not a Chapter 7 is possible are quite complex. Only a complete and thorough review of all facts and circumstances from a bankruptcy lawyer can determine your rights under the Bankruptcy Code.

Chapter 13: This plan allows those with a regular income to consolidate their debts into a 3 or 5 year plan. The plan must provide that secured creditors (home mortgage companies) be paid enough to catch up on past due amounts and then the debtor stay current.

Chapter 13 requires that some state and federal tax debts be paid in full. Other creditors (usually unsecured creditors such as credit card companies) may be paid 100% over the plan or a smaller percentage.

The length of the plan is determined mainly by the income of you, the debtor. Chapter 13 is usually the way people avoid home foreclosure and car repossessions. A valuable benefit of a Chapter 13 is that interest stops on many debts, including tax debts. Sometimes second mortgages can be eliminated.
