What is tax bankruptcy?

A Chapter 7 or Chapter 13 filed primarily to deal with taxes. Unlike what you may have been told, the Bankruptcy Courts can provide you a discharge for many tax obligations.

The rules on what taxes can be discharged in a bankruptcy are quite complex and only a lawyer knowledgeable in tax and bankruptcy law can fully advise you of your taxpayer rights in Bankruptcy Court. But if your taxes qualify for a discharge, this is nearly always the best way to deal with your outstanding tax debt. It may be that only a portion of your tax bill can be discharged. If so, a bankruptcy may still be the best option for you. You can obtain a discharge for that portion that can be discharged, and negotiate an installment agreement for the remainder. While the bankruptcy is pending the IRS cannot garnish your paycheck or levy your bank account.
